Looks like I will be seeing Pegasus in court!

I have now received the court paperwork courtesy of Alec Butt/Pegasus and his poorly made faulty truck top.
There is no way I am letting this go to mediation. I shall be seeing him in court.

The plural of anecdotes is not data. Anecdotes however, are better than hearsay.... And keep your NOx and particulate emissions LOW - it's better than killing your kids.... Only meant for those that mod in a way that adds to pollution!

If the events are as you say, and you can back this up with some evidence, I would stick to your guns.

If you are offered mediation, this would indicate that the claim has been assigned to the Small Claims track in the County Court. If this is so, legal costs cannot be recovered from you unless in very special circumstances where you have acted completely unreasonably. The idea of the Small Claims track is to keep costs to a minimum and allow people to pursue cases without formal legal representation.

If you've just received the paperwork indicating that you intend to defend the claim, then from my experience (last year), you will be looking at 6 to 7 months before the hearing date.

If you need any help with the court process, I'll try to help as far as I can.

The very fact that they ignored your initial complaints and contact... then they sent a third party to investigate to the conclusion that the top needs replacing!! They haven't got a leg to stand on!!
I wouldn't worry about it to be've had a refund...
They are just trying it on with the legal stuff...
I would email them giving them 7 days notice to collect the top after which you will dispose of it and send them the bill if you incur costs...
Then just forget about the whole thing...
Not worth the head space.
Thanks for the heads up with this company too, I can't believe the way you've been treated it disgusting!

Just had a look on their website, their hardtops are ******* ugly in my opinion and Deffo wouldn't dream of buying one.

I've just stumbled across this thread as it was linked on another discussion. I also had the misfortune of dealing with this guy and found him rude and objectionable so can understand your frustration.

I would never deal with them again, the product was of poor quality and poorly installed but due to his attitude and general rudeness I chose to just accept it rather than complain. This goes completely against the grain for me as I genuinely believe when you pay good money for something it should be right! I just felt that pursuing him would be a horrible process that would cause me too much frustration which I didn't need in my life at that time.

Good on you for standing firm, I really hope you get the right outcome.

Any update on how things panned out? I had also consider a Pegasus top for my new np 300, but due to price and this sort of feedback it's also off my list.

Had mine fitted recently, excellent fit, works well and looks great, never met the chap referred to as rude so can't comment on this but I found the company very reputable.
Yes not cheap, but cheaper than the one Nissan offered, in my opinion a far superior and stronger product, looks a better shape, but maybe that's just personal preference.
I can't understand why they should take this stance, it's not going to get them anywhere, surely they are aware sales will be affected, as they say "mud sticks "
I had ordered mine prior to picking up this thread so was very apprehensive, but thankfully hardtop is perfect for me.

Glad to hear that it works for you. Agree looks better and spec sounds better than more expensive Nissan option.
Did you get them to fit? If so what did they charge on top of purchase price?

Did you look at their tailgate assist product? Would be interested to hear from someone who's seen/used or had one fitted?
