Not for me thankfully, but my mate had a nasty one on the weekend (squeaky clean, not his fault at all) BMW driver who clipped his trucks back end (Coming head on) way over the speed limit while in the wrong lane (oh, the BMW was overtaking a car turning right!) . He swerved his truck right onto the verge to avoid but wasn't enough and his truck spun into the lane of oncoming traffic where he promptly got hit again. Pretty sure the driver was DUI, he reeked.

Truck is a wreck but thankfully him and his partner are alive, but very battered.

Obviously next step is insurance claim etc. Police were there but although I've got a lot of general respect for the fuzz they really screwed it up, the scene was absolute chaos and they didn't breath test the beamer driver.

That said, although I've had the unfortunate experience of doing this a couple times, has anyone got any advice for maxing claims etc? I'm pretty incensed frankly, particularly as the same driver/car nearly had a head on next to me the other week down the same road. Too busy trying to survive to take his plate at the time.

I've made sure my mate gets written independent injury diagnosis, and we'll throw the book for whiplash, multiple moderate - severe injuries, loss of income (work truck and he's a plant operator, something he'll struggle with for a while as he's got a busted shoulder and knees), loss of future income, trauma etc but just interested if anyone has other advice? Anything that can be done extra for fair evaluation of his trucks value?

We have videos, statements, witnesses and everything.馃憤

There's idiots on the road, nearly all driving BMWs and Audi's, plus some Tesla ones too.

There most crashed car in the UK is the 4 series BMW.

As for claims, he needs a good solicitor. Not one of those no win no fee cowboys.

For valuation, he needs to insist that they pay out the price to replace with an identical vehicle. Definitely not the CAP value which is what they will try.

Thank you, that's very helpful. 馃憤 He's got legal cover so I'll make sure he uses it. He had a dodge ram so it should be quite quick to spot if the companies valuation is out, that's very useful to know.

You would assume that the BMW's insurance company won't fight it, seeing as their insuree wrote off 3 cars/100ks+ of vehicle in one accident. But from experience cornered desperate idiots fight the hardest so...

And yes, succinct summarisation of idiot drivers.

Hopefully the BMW driver did have insurance...

Actually they tend to dispute a lot more on the big claims. It's the personal injury stuff that really needs attention, I had a friend rear ended with genuine whiplash and it took months even to get a medical examination.
It was a couple of years before it was settled which was shocking, he didn't have a car, couldn't drive and was limited around working. He still suffers and that was nearly 10 years ago.

Yeah, I think he did thankfully.

Ouch, that's nasty and quite disgraceful frankly. proper nasty stuff.

My mate is really banged up, torn shoulder and knee so I've got him going to a physio asap for diagnosis, and also get him to write a written diagnosis to add weigh to the claim. Bit of a lottery tho, some insurers like to have a GP's letter, some like a specialist report but either way the first priority is to get him sorted out so 馃

Interesting that they dispute big claims more. We'll see how this one goes馃
