good morning,
Just bought a nissan navara outlaw 05 plate had it a month,done 685 miles( mileage 77000) on way to carnforth (west coast uk)when con rod decided to puncture a hole in the engine.full mot ,full service bought it from toyota/lexus used car garage in bradford,who after a couple of days picked it up from rrg toyota in bolton,left a nice pool of oil on forecourt!!
I have a 3 month warranty on the nissan will i be covered,is it classed as a major mechanical failure or will the garage try and wriggle out of their obligation,i did my research before buying the car and i cannot remember seeing the article about the infamous d22 engine destroying itself,i am now led to believe that nissan are actually aware of this problem with the con rods which i find unbelievable that they haven't issued a recall, we were lucky in one respect that the oil (loads of it) didn't cause an accident to following vehicles.
No warning doing a steady 60 mph suddenly BANG, oil everywhere..
any suggestions????
hopefully my used car toyota warranty will cover me otherwise i'm in **** street
 
Seller will have a job getting out of the warranty by saying it is fair wear and tear as it is a known problem / fault

Don't just let them bung another used engine in or it'll happen again!
Unfortunately, another 2nd had unit might have to be accepted, because if the put a new one or rebuild this one he will be in a better position than he was with the original. In civil law there is something called 'betterment' and if he is into that that they have to right to ask him to pay for that 'betterment'. That does not mean the whole cost of repair though. Start with asking for everything, but dont expect to not pay for any of it, depending on what you end up with.

garage gonna ring me monday to see where i stand ( on the hard shoulder you Basxxxds)
All they told me on friday was that something had perforated the engine....

X2 if it comes from bilcar you know it's going to be good

But that's a last resort. Needs to hear dealer offer first.
If dealer only offers a scrappy replacement then apart from rejecting the idea, could then say put toward a proper BNillcar one.
 
Good point say to dealer get it fixed buy the way it's going bilcar to be fixed and your going to pay for it

Just rang billcar engineering who quoted ÂŁ2500+ VAT ,3000 then,might try to go down that line,they upgrade all the ***** bits nissan should have done in the first place...
will wait to see what toyota bradford say when they ring me ,hopefully today..

the last thing i want is for them to bung another recon engine in with the same **** in it.
Can't believe i have an 05 ,77000 mile car which i am paying for,for 5 years,and the engine is on a workshop floor,NISSAN SHOULD BE ASHAMED OF THEMSELVES!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
 
get the garage to replace the engine with an engine with normal parts then go to bill car and have the mods carried out.

The garage would be silly not to do that as it would transfer any liability for the replacement engine to Bilcar, once bitten twice shy sort of thing, as obviously they would have to stand over any work they did.

Right ,garage rang me last night, admitted it was the con rod problem,they reckon that the toyota used car warranty will only fit a NEW engine at a cost of ÂŁ8000,as my truck cost shy of ÂŁ6000 i can't see them agreeing to that. He then said they (garage) will fit a recon with the modified bits at a cost of roughly ÂŁ2000, i got the impression the onus will be on me to cough that up.
Been in touch with trading standards the reckon IF it can't be sorted out to go down the SALE OF GOODS ACT,basically to repair,replace or refund.
I asked the guy at the garage about the possibility of billcar doing the work etc , i'd even pay for the truck to be shipped down to shrewsbury!!! but he seemed reluctant to do that,even though billcar offered to deal with the garage directly.
Seems a no brainer to me,i'd be quite happy for a recon modified engine to be put in , i'm happy (to a point) the garage's reputation is intact and the warranty company are only shelling out a fraction of the cost of a new engine..
Still stand by my words tho....................

You said it, don't pussy foot around with the dealer.

They either fix the problem (to your satisfaction) or give you a refund., in which case you can buy another truck knowing the pitfalls.

Update.....
Just had a phone call from the warranty people, the ÂŁ8000 NEW engine is a non starter(not literally) they have suggested a possible ÂŁ5700 refund or maybe billcar fitting a recon modified engine,they are gonna get back to me .Seemed st suggest that it was up to me... SHOW ME THE MONEY!!!!!!!!.
 
Been watching this thread, you dont want the refund bud, if they gonna pay for Billcar to do your bottom end, then get it done, that truck will run for flipping years without a load of hassle. besides, you always have this lot to fall on in times of distress!

We all guarentee Bottom end WILL NOT fail if Billcar do the mod :thumbright:

You'll have the trustworthiness of the Mk1 & the facelift of the Mk2.
