I had the oils changed recently, but first time I've used 4 wheel drive it also won't go in 4H while on the move, could it be the wrong oil?

It should be 2.0 litres Genuine NISSAN ATF or DEXRON III/MERCON Automatic Transmission Fluid.

I wouldn't put it past a garage that is not well versed in the D40 to use heavier transmission oil.

As them what they used then hit them with what they should have used.

Kept trying it and eventually it went into 4H but feels like something is locking or dragging somehow, i am thinking front diff as this is the only extra part of running gear working, or am i wrong

On a sealed surface (tarmac or concrete) the tyres grip so much it causes transmission wind up. Not something you want to do.

Try it offroad on grass or gravel and it should be fine.

Right ******* to get in, i ended up using a weed sprayer (New) with the head removed to inject it for want of a better word.
